Integrity Personnel
Terms and Conditions of Business

Effective as of April 2008

These Terms and Conditions of Business are between Integrity Personnel Pty Ltd ABN 52 084 470 860 and / or any subsidiaries or associates, and the client employer and / or any subsidiaries or associates.

The acceptance of a candidate introduction made by Integrity Personnel, whether the introduction is made verbally or in writing, will be deemed as acceptance by the client employer of the Terms and Conditions of Business detailed below:

Permanent Recruitment

  1. All candidates referred by Integrity Personnel will be considered as "active" candidates for a period of six months from the date of referral. If the client employer appoints any such "active" candidate in any capacity during this six month period, a fee will be payable as detailed in Point 2 below.
  2. The fee payable to Integrity Personnel by the client employer for the introduction of a successful candidate is calculated as a % of the total annual remuneration* paid by the client employer to the candidate as follows:

    Up to $49,999 per annum 15% fee
    12 week guarantee

    $50,000 to $69,999 per annum 17% fee
    12 week guarantee

    $70,000 to $99,999 per annum 18% fee
    12 week guarantee

    Over $100,000 per annum 20% fee
    12 week guarantee

    * Remuneration is defined as base salary, superannuation, allowances, guaranteed or advanced income and motor vehicle (the value placed on a motor vehicle for fee purposes is calculated at $15,000 per annum).

    Minimum $3,000 fee will apply to any permanent full or part time placement, including Temporary to Permanent placements.

    Advertising: Integrity Personnel will cover all lineage advertising costs, however, "display" advertising at the client's request will be charged to the client employer (at cost).

  3. Fees are payable within 14 calendar days from the candidate's commencement date.
  4. Our service is covered by a guarantee period from the candidate's commencement of employment, in the event that a client employer should terminate a successful candidate placed by Integrity Personnel, or should the successful candidate decide to leave the client company.

    Our guarantee will only apply if the client company has paid the placement fee within 14 days of the candidate's commencement date, and gives Integrity Personnel the exclusive opportunity to secure a replacement within a reasonable timeframe.

    If these two conditions are complied with, Integrity Personnel will seek a replacement and the fee already paid by the client employer for the terminated candidate will be credited against the fee payable for securing a replacement. The client employer will receive a credit or be billed for the difference between the original and replacement fees, should the remuneration package differ between successful candidates.

    Credits may be used within the Integrity Group ie, Accountancy Search and / or Integrity Personnel for temporary and / or permanent services.

    Please Note: our guarantee covers a maximum of two replacements for each original placement made.

  5. Integrity Personnel agrees to make every reasonable effort to ensure the suitability of candidates supplied, but cannot accept responsibility for the actions or behaviours of candidates, including any loss, expenses or damage, however incurred.
  6. References supplied by Integrity Personnel are a summary of the comments made by referees and the client employer agrees to further qualify the content of references as deemed necessary.
  7. All permanent fees are subject to an additional 10% GST.

Temporary Recruitment

  1. Temporary staffs are supplied under the conditions of the Clerical and Administrative Employees in Temporary Services (State) Award. Our rates are inclusive of temporary wages, superannuation, workers' compensation insurance and all associated payroll and administrative costs.
  2. Where a temporary employee is offered direct employment by the client employer, or any subsidiary or associated company, in any capacity, during a current temp assignment, a "release fee" will be payable by the client employer. This fee will be calculated as a % of the total annual remuneration offered to the temporary employee, and will be charged according to the structure set out in Point 2 of Permanent Recruitment (Page 1).
  3. Where a temporary employee transfers to the payroll of a client employer, or any subsidiary or associated company, in any capacity, within six months of completing an assignment, or following a referral by Integrity Personnel, a placement fee will be invoiced to the client employer.

    This placement fee will be calculated as a % of the total annual remuneration offered to the temporary employee / referred candidate, and will be charged according to the structure set out in Point 2 of Permanent Recruitment (Page 1).

  4. Following the completion of any temporary assignment, or after the referral of a temporary candidate, further contact with our temporary employees must be made through Integrity Personnel.
  5. The Clerical and Administrative Employees in Temporary Employment Services (State) Award and / or relevant award or previously agreed individual contract between Integrity Personnel and the client employer will govern the minimum length of a temporary assignment.
  6. During the course of any temporary assignment, the temporary employee is at all times under the care and supervision of the client employer in regards to defined working hours, safety regulations and the manner in which the work is to be performed.
  7. Hourly rates will vary according to the classification of the temporary employee, the length of assignment, and are subject to the Clerical and Administrative Employees in Temporary Employment Services (State)

    Award and / or relevant award. Hourly rates are also subject to change following any Wages Board decision to amend wage rates or allowances (including increases to Superannuation).

  8. Overtime and allowances will be calculated according to the Clerical and Administrative Employees in Temporary Employment Services (State) Award and / or relevant award. Under the Clerical and Administrative Employees in Temporar y Employment Services (State) Award, overtime is payable where a temporary works in excess of 8 hours in any one week day, and / or in excess of 38 hours in any Monday to Friday week. Saturdays, Sundays and Public Holidays also incur overtime penalties (details available upon request).
  9. Settlement terms are STRICTLY 7 DAYS as our invoices are for wages already paid.
  10. All temporary rates are subject to an additional 10% GST.

Collection Costs

All fees incurred for the collection of any overdue accounts may be passed on to you the client at the discretion of Integrity Personnel. In the event of non-payment, we reserve the right to charge an account keeping fee at a float rate of 1% per month unpaid invoices from the due date to the receipt of payment.
